Awards of costs in immigration tribunal appeals

If you are not in the UK at the time of submitting your appeal, you cannot apply for help with fees. Find out how to appeal against a visa or immigration decision. The outcome of an Appeal following a malpractice decision may be a confirmation that the result remains withheld or an overturning of this decision which leads to the release of the result. If the Appeal is upheld the results will be released and a Statement of Results and Certificate will be issued. Please speak to your centre who will be able to confirm the fee.

Your lawyer will speak to the Home Office on your behalf, meaning that you don’t have to worry about contacting UKVI. Working with an immigration lawyer does not guarantee a successful decision, but it can significantly reduce the work involved in an immigration application. During the application, you will be given a document checklist and a postal address to send your application.

Conditions for Appeal

Appellants must submit a completed Appeals application form and make payment to the Centre or directly to Cambridge by the end of the 21-day period. A Chief Assessor who has had no previous involvement with the result in question, reviews the documentation and prepares a report on your performance and/or the specific points of any complaint about course provision. The report is then sent to an Independent Reviewer who endorses the decision where appropriate and confirms that the Appeals procedure has been followed correctly. If candidates are not satisfied with the outcome of the Result Enquiry process, they are entitled to request a formal appeal against their grade. The appeal is submitted within 14 days of the receipt of the relevant decision. If you would like information or advice, please contact your nearest centre (or in the case of an IELTS test taken at a centre authorised by IDP Education Ltd, contact ).

The exact form which must be completed depends on your particular situation, and a list of forms can be found on the GOV.UK site. In order to appeal, an appellant must give “notice” to the tribunal. See our appeals collection for further detail on what grounds of appeal can be raised.

Enquiries procedure

How you appeal depends on whether you’re applying for yourself or if you’re a legal professional appealing on behalf of a client. Your decision letter will usually tell you if you can apply for an administrative review if you do not have the right to appeal. You will need to set out your reasons clearly and may be able to discuss repayment of your appeal fee. A fee award is when your appeal has been successful and a judge has ordered the Home Office to pay you back. It is paid by the Home Office but may appear on your bank statement as paid by HMCTS. You can only apply on someone else’s behalf if they are a child or they lack capacity.

Whilst most determinations will be provided within 4 to 6 weeks following the hearing, sometimes they can take longer. Whilst it is possible to lodge an appeal outside of the above time limits, generally speaking, the Tribunal will only agree to hear an out-of-time appeal in exceptional circumstances. If the appellant has been given an in-country right of appeal, they will usually need to lodge their appeal with the First-tier Tribunal within 14 days of the Home Office decision.
